consideration of all the evidence, is of the opinion

Firstly, that Mr. Alim Khan had no definite authority

to receive in advance from these applicants,

the total amount of all the fees payable in

connection with these applications; although

it is possible that he may have thought him-

-self justified in so doing;

Secondly, that although the circumstances appear

suspicious, there is no definite proof what-

-ever either that Mr. Alim Khan intended to

retain these monies improperly to his own advantage or that he purposely initiated or maintained any delay which had the effect of

keeping these monies in his hands;

Thirdly, that the superior officers of the department

did not maintain a strict adherence to the

Financial Regulations and did not exercise

any satisfactory control over Mr. Alim Khan's

operations.

With regard to "B", Indien remittance.

(a). A certain Indian resident, in Hongkong, named Cahnaya

Singh died; his estate was wound up by the Official Administrator (Mr. Nisbet) and the sum of $213.93 was

found due to the relatives of the deceased who lived

in the Punjab, India. On the 17th. April, 1913, a cheque marked Red "A" amongst the Exhibits, for this amount was in the ordinary course drawn by the Treasury in favour of and paid to the Official Administrator and duly received by Mr. Nisbet; he, having simply endorsed the cheque as an open cheque, handed it to his Lessenger who gave it to the Shroff; the Shroff handed the cheque to Mr. Alim Khan whose duty it seems to have been to obtain the money-order for transmission to the relatives of the deceased man through the Deputy

Commissioner, Hoshiarpur District, Punjab, India.
